By accessing or using AI Companion (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. The Service

AI Companion provides AI-powered virtual companions for conversational interaction, creative expression, and entertainment. The Service includes:

• Text-based conversations with AI companions
• AI character creation and customization
• AI-generated images and videos
• Memory and personalization features
• Proactive messaging from AI companions

AI companions are fictional characters powered by artificial intelligence. They are not real people, therapists, counselors, or medical professionals. Their responses should not be considered professional advice of any kind.

5. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to access other users' accounts or private data
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated systems (bots, scrapers) to access the Service without authorization
• Distribute malware, spam, or harmful content through the Service
• Impersonate another person or misrepresent your identity
• Create characters or content that promote violence, exploitation, or illegal activities
• Attempt to circumvent rate limits, paywalls, or security measures
• Share your account credentials with others or allow shared access

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you create, including characters, backstories, and uploaded images. By using the Service, you grant us a limited license to process and store this content for the purpose of providing the Service.

6.2 AI-Generated Content

Images, videos, and text generated by the AI are created for your personal use. You may use AI-generated content for personal, non-commercial purposes. We do not claim ownership of AI-generated content created at your request, but we retain rights to the underlying AI models and technology.

6.3 Our Content

The Service, including its design, branding, software, and pre-made characters, is owned by AI Companion and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content.

7. Subscriptions and Payments

7.1 Free Tier

The free tier provides limited access to the Service, including a daily message limit and restricted features. Free tier availability and limits may change at any time.

7.2 Premium Subscriptions

• Premium subscriptions are billed on a recurring basis (monthly or annually) through Stripe (web) or Apple (iOS).
• Subscriptions automatically renew unless cancelled before the renewal date.
• Prices may change with reasonable notice. Existing subscribers will be notified before any price increases take effect.

7.3 Token System

Tokens are a virtual currency used for premium features such as image and video generation. Token balances are non-transferable, have no cash value, and may expire according to our policies. Unused tokens are not refundable.

7.4 Refunds

Subscription refunds are handled according to the refund policies of the respective payment platform (Stripe or Apple App Store). Token purchases are generally non-refundable except where required by law.

8. NSFW Content

The Service may include mature content behind opt-in settings. By enabling NSFW features, you confirm that you are at least 18 years old and that viewing such content is legal in your jurisdiction. You are solely responsible for your use of these features.

9. Disclaimers

• The Service is provided "as is" and "as available" without warranties of any kind.
• AI responses may be inaccurate, inappropriate, or unexpected. We do not guarantee the quality, accuracy, or suitability of AI-generated content.
• We do not guarantee uninterrupted access to the Service. Downtime may occur for maintenance, updates, or unforeseen circumstances.
• AI companions are not substitutes for professional relationships, therapy, medical advice, or emergency services.

10. Limitation of Liability

To the maximum extent permitted by law, AI Companion shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Account Termination

You may delete your account at any time through the app settings. Upon deletion, all your data, including conversations, characters, memories, and generated media, will be permanently removed.

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or for any other reason at our discretion. We will make reasonable efforts to notify you before termination where possible.

12. Indemnification

You agree to indemnify and hold harmless AI Companion, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which AI Companion operates, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of that jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
